This free course focuses on the use of exclusion clauses in contracts. Exclusion clauses are terms of a contract which seek to exclude or limit a party’s liability for loss or damage. The course looks at when and how such clauses are used, the approach taken by the courts and the role of legislation in this area. After studying this course, you should be able to discuss the purpose and common uses of exclusion clauses identify whether an exclusion clause has been incorporated into a contract and what is covered by its wording, assess the impact of domestic and European legislation on an exclusion clause, and evaluate the balance the law strikes between freedom of contract and consumer protection.
